Topic Wiki

This thread is to discuss whether people feel that something is unethical, not to find out what the law*/T&C says.

Any Halachic questions should be posted here.

*According to CountValentine this includes religion, but unfortunately for him, the general consensus is that religion will always be entwined in this thread.

*Hint* If you have to ask, It's most likely not ethical.

That would leave me with a negative post count larger than my current post count. >:(

OTOH if that was the case we would probably be able to keep CM with us a little longer (heck, HM would probably still be with us) :P

LOL
I'd actually love to hear CM's insightful take on this conversation. Also, the fact that there is even an 'Is It Ethical' thread on DDF should speak volumes.

If there's no risk involved then keep it, No reason why should give it back, period!

But is there no risk. Should I be scared that Amex will come after me down the line?

They can and it is highly possible. Happens when banks sometimes mess up and deposit too much into someone's account.

The most they can do is take back the money, you did nothing wrong from your side.

I know it's essentially the same thing as selling miles (in terms of violating the T&C), but I'm bored at work, so let's discuss once again.

Is it okay to sell a hotel night that you have (such as Omni) when the T&C say you cannot resell your reservation?

Let's take a look at the 3 highlighted sections. First off on the left, it clearly says you cannot resell a reservation. Ok. Can't resell. However, it does say on the top line highlight that "invited guests" are allowed. So, one could technically rationalize that they're inviting Person X as their guest, and he happens to be paying them for the offer of letting him stay in the hotel. Strong argument? Eh, not really. The point of that T&C is likely that you can bring your friends with you to the hotel. The last highlight is what really throws me off, though - they can make terms that state you are not allowed to make speculative bookings? I can't book a hotel night in NYC on New Year's in the chance that I might visit NYC that night? Really? Since that statement seems crazy, it kinda throws the whole T&C into question - did they just make up random stuff? What are they actually allowed to limit?

Those are my thoughts. Anyone else?

It's obvious that per the T&C's you can't resell. Invited guests mean you can bring your wife, kids and friends along with you.

In terms of what they can limit, they are a private company offering you a service and can limit whatever they want (as long as they are not discriminating).
There is a spectrum of 'speculative.' I assume they are trying to exclude you from making a booking you don't plan on using at all. The rest of the spectrum is hard to quantify.
Life isn't about checking the boxes. Nobody cares.
