Once asked Reb Nechemia Goldstein (i beleive thats who it was, he was a posek that learnt in sadigur) in Yerushalayim about this kind of scenario, he did not want to pasken without hearing both sides. He did tell me as a general rule once a store accepts the credit card agreement they are bound by the terms including all the rules they have regarding disputes.
as a side point a local merchant once told me he hopes most people dont know that a dispute costs him money because otherwise he is not mochel them. he said very often people make a dispute for not being allowed to make a return even though the return policy is posted
That could happen unintentionally. If the purchaser is trying to file a return protection claim and does not use the right terminology, the phone rep might enter it as a dispute.
I highly doubt that
happened when I made my wife call to file a return protection. She ended up disputing by mistake. Thank Gd it wasn't a Jewish owner

Some stores have a habit of not allowing returns pr being unhelpful even when the product is defective. I have had stores refuse to help at all when a pair of shoes was coming apart after wearing for an hour.
