« on: May 10, 2013, 03:12:09 PM »
So I have three nests around my house. Check under your decks and in sheltered gutters. You may be able to be mafkir them and do a big mitzvah. [Ask ur LOR]
(This is for info only. Dont contact me asking to come and do it, I have my hands full with family and (their) friends...Sorry)

They have to be kosher birds.

They are, though the definition of kosher bird is more lenient for the mitzva of shiluach haken than eating.

This makes me nervous.  There are many opinions as to how to do the mitzvah, and if you do incorrectly you've done more harm than good.  I try to stay away from doing Shiluach Hakan (unless for some reason I actually want  the eggs/chicks)
If you don't care why would you comment?

You send away the mother and take the chicks/eggs of a kosher bird. the only other requirement is that It should not be motzui. The opinion of the vast majority of poskim is that if one works out a legitimate way that his chotzer shall not be koneh the eggs, (or possibly a hefker mechanism after eggs are layed) the mitzvah applies.
Feeling bad for the poor mother is entirely understandable, but after all the mitzvah is based on this idea of sending her away and minimizing her pain. This is G-Ds will.

Anyone read The Year of Living Biblically? He has a pretty entertaining account of him doing this Mitzvah.

Btw I had an interesting thought, recently read a scientific study in which they explain how sometimes birds will repeatedly fly into a glass window. Basically the bird sees itself in the reflection and is trying to protect its territory. The fascinating thing is, that the reason why they repeatedly do it is because they have an extremely short time memory- a tiny bird brain. maybe sending her away causes her to forget about her chicks...?

-1 I know this is contrary to popular knowledge but the gemara calls it a lav hanituk l'aseh and if I recall correctly the chasam sofer paskens not to do it unless you need the eggs

IIRC there's a zohar that says that one of the reasons for the mitzvah is that when the mother cries to hashem, it awakens his mercy and is mekarev the geula.

Ulay yesh loimar, that when a bird smashes its head against the glass it suffers short term memory loss and will do it again, but in general they do have some sort of memory.

You are correct that the Chasam sofer in Shu"t Oc"h 100 strongly implies that the mitzvah should only be done if one has a use of the chicks, eggs or some other need for the mitzva (-segula??), and to do it stam lishma may be achzorios. But this is contrary to the opinions of most of the Achronim and against the established custom. In the various books on the topic many gedolay yisroel are pictured doing the mitzvah while they surely had no use for the eggs.
It is though intellectual dishonesty IMHO on behalf of the sefer "shaleach teshalach" to not even mention or allude to this mahalach of the Chasam sofer though....
