I purchased a BB picked it up. While there I notice a small  speck. When I came home and tried wiping it I realized it was scratched, in more than one place. Called up, seller claims it can't be, "only activated", must have come that way. I could tell that it was obviously dropped.

Loooooong story.

I bought this to ship to s/o who purchased my brand new BB on ebay but I made a mistake in the listing so bought him this one. I offered him a $30 refund due to scratches and he accepted. After having trouble activating it he bought one from the store and asked for a refund, I responded that since  its not stolen, no refund. I had verified clear ESN. So he opens case - for scratches! I spoke to ebay and realized that I would lose this SNAD so I let him return it for a refund and opened a SNAD case against my seller.

The seller did not respond so I escalated and won. A week later the seller sends me this nasty email that just because they didn't check ebay they lost and her husband is district attorney and they have opened a small claims case against me. (We live in the same state)
Where do we go from here. How do I figure out if her husband is really DA ( I don't think its worth it for her to pursue it otherwise).

OK so she's lying I figured out her town does not have a DA and her husband has a different job (Thanks Google!, it wasn't that easy though)
Question is what are her chances in small claims court. Is eBay in any way legally binding?

How much did you pay for the phone?
It does cost $$ to file for a case in small claims court, probably just empty threats as I can't imagine that it would be worth it.

Did you take any pics when you got the phone?

Yes I've got lots of pics, the phone was 350! paid in cash (it's a yid  :( I asked a really machmir Rav before opening case.)

"Outside of eBay" means that eBay doesn't get their fee. It is perfectly within their terms (albeit not very smart) to pick up the item locally, and pay with cash, as long as you don't go ahead and cancel the transaction.

I am wondering if there is a way to export My eBay to excel (won items). I found this program called myebayexport, but it didn't work.

I believe that there is a way to export to csv.

I'm not sure, but when you look @ the fees you pay, I believe you can export everything from there.

it is, but as eBay ym"sh charges for every movement, and they need to itemize what they charge you for, you should get a complete list.

I actually found that app. which I mentioned but apparently its no longer compatible.

First I  spoke to Ebay and they told me t contact them if and when I get a court summons. Next, once I realized that she was lying about the DA I figured she was just upset. So I sent her an email that I had all the correspondence between us and I wasn't scared of her. And for good measure I ended off that my wife is DA in my town! Never heard from her again
