Sold miles, broker never used them, what's their status?

Just like when you go to a supermaket, the owner does not follow you home to make sure you use the item you bought from them.

When you sell miles you sell the account. Its not yours anymore. PERIOD.
I sold my car 3 years ago but the buyer never uses it, he leaves it parked in a parking garage forgotten. Yesterday I found my spare key and off I went in "MY" car. After all for 3 years he didn't use it......

Might be hashavas avaida to remind the broker if he forgot about them

Yes, Miles are different. The biggest issue is not having anything written down black and white. Things are just expected and assumed.

In general these things should have terms set up at the time of sale.

-How much time to use the miles?
-Is the AH cc included?
-Can the broker resell the account?
-Can the broker add miles?
-Is the account being sold or just some of the miles?
Etc.
Make these things clear and these issues won't come up.

This thread inspired me to look back at what I sold in the past year or two, and see if those accounts were not used yet. Had one small one that wasn't and I was able to remind the broker about it to use it. Sold it to him over a year ago.

Interesting read here. Seems like miles, because they are somewhat intangible ppl have all kinds of ideas about it. I don't buy miles but I do buy gift cards. If I purchased a Dell Gift card from someone and didn't use it within a specific time frame I would consider it out right stealing if the seller tried using it on his own even if it's about to expire.
Also I wonder if you can use זוטו של ים before it actually expired. Until that point to when it expired it still usable by the buyer and should still be his. Just because the seller still has access to the item he sold and it's being stored by him that shouldn't change the dynamics.
