Transcript of my conversation with Walmart Rep.  Charles: I am really sorry but it seems like the fulfillment center made a mistake an mislabeled the item, my apologizes for this I will fill a report to make sure they are aware of this. Can I offer you a refund and you can keep the item as a compensation?
me: I'm sorry I don't understand will they send me the other tissue boxes
charles: No, I am rally sorry for this. That bundle of 36 boxes doesn't exist.
me: The price before the sale was was around $70 I can't imagine Walmart was selling 1 box of tissues for $70
Charles: you pay 10.25
me: no on charges 10.25 for 1 box of tissues second of all I got it on sale
Charles: Yes, that is correct. If I was capable of completing your order I would I am really sorry this happened Do you accept the refund...

so they claim the bundle of 36 doesn't exist this is a lie as I argued and second of all they are still selling it as you can see

They owe me a refund without me having to work on the return for more than a second. If they personally want to pick it up when I'm home, no problem but they have to pack it and label it...

If you have been reading through the thread you'll notice that I'm not the only one that was told this to others said they were told the same thing a friend of mine told me he was told the same thing so no it wasn't just my rep. it's walmarts talking point which is an out right lie and they owe me the other 35

If they did not offer a pickup that is a different story. Would the CC ask if you contacted the seller and if they would allow you to return it? What do you think the CC would say if they were told that you were offered to return and given a shipping label?

Told the JP Morgan guy everything as it happened and that I started using them so I couldn't return, it's true though I sent them straight to the Shul. This is the second time in about 4 years that it got to the point that I had to file a dispute so I don't think I'll have much issues getting a refund!

In your case where they started getting used that is a much stronger argument.

Any court or Beis din... if they really want it they can come and get it, till then...

Convince yourself. Maybe ask someone who has some knowledge of choshen mishpat. Mekach Taos never allows you to keep the item. You certainly would not have a right to a free iPad.

What right would you have to use something you never bought or paid for? They can technically refund you everything except the value of what you are keeping I guess.

Either they really made a mistake - there is no case of 36 - someone pressed the wrong buttons and accidentally it showed up as priced at $12.05 then $10.25 etc
OR they made a mistake to price it too low and they're back tracking now.

Anyone who truly believes that Walmart is backtracking to intentionally charge everyone $10 for a box of tissues instead of simply cancelling orders needs some xanax for their paranoia. After selling hundreds of items at significant losses why would they suddenly do this over here? If the mistake is that someone keyed something in incorrectly then why would that not be a mekach taos?

I chatted with them this afternoon for a while & no luck....problem I have is that one of my family members opened the actual tissue boxes that I got....so I can't even return them!!!

Just send back the empty boxes! They deserve it!!

Honestly, I can't believe the pretzel people are twisting themselves into for a stupid box of tissues. At least do it for something more substatial. I get that WM CS is not AMZbut AMZ policy is their business decision not an entitlement.

I can't say I understand the entitlement some here feel to keep the tissues which came. As long as Walmart is ready to arrange a pickup why should you not be obligated to return the item you did not pay for?

Offered to pay the price of one box out of 36. They declined and set up fedex pickup when i specifically said not to set up because i wasnt home. Was harassed all day by Fedex for pickup. Yes, I'm entitled to compensation for 2 hours on chat and another 15-20 minutes on phone plus unpacking. Wholesale value of 51 boxes, less than $50. Value of my time is more than that for 1 hour. I dont feel one iota of remorse for keeping the tissues and for the free $10 GC. I lost money on this if i dont resell.
