Im just blown away by everyone acting as judgr jury and executioner without any of the facts. If the guy was drunk, you lock him up and throw away the key? If he was mentally unstable do you lock him up and throw away the key? If he was high om drugs do you lock him up and throw away the key?

Thats why everyone that yells prison reform and sentencing reform are just a bunch of liars. Until you can humanize "criminals" youre all blowing hot air. There are very few people who wake up in the morning and say...hmmm, let me run over a cop today. There are psychopaths and sociopaths. But the majority of people who commit stupid crimes are neither.

Try this on for size. A guy I met at rikers who was drinking with his wife and mother blacks out. When he comes too, he finds his mother fell and hit her head and is dead. He chopped her up out of shear panic. He is charged with murder even though they cant prove it. What does he get? Is he a psychopath?

Not my job, thankfully. Thats why judges shouldnt be political hacks.
So therefore you have no opinion other than that 25 is too much? How do you know that if it is not your job?

What's the issue? Isn't it normal to chop someone up when you panic?

Exactly...guess @AJK has something to look forward to.

I was very leary of my crim law professor who was as left wing liberal defense attorney as you can imagine. After going througj the sysyem I'm not as leary. Im more leary of overzealous prosecutors and law enforcement.

I mean no disrespect, but the fact that you even remotely believe this story evidences to me how out of touch with reality you are.

You may not be a "bleeding heart liberal," but believing a guy cut up a family member "out of shear [sic] panic" is mind-boggling.

Other than the place you went to was deplorable what else about the system do you feel was unfair, your sentence?

No clue with the cop story. Guess it will be in the 7 year range. Murder depends on whether it was premeditated or crime of passion. Premeditated, if proven, lofe or death penalty if available. Crimebof passion 15 to life which allows for parole review.

So why are you saying that this kid's sentence of 25 was crazy? It seems to fit into your guidelines

Not my story, it was in the papers that way. I have nothing to believe. COs confirmed it as well. The ones who killed people were very open about it. He was scared.

Which kid?
Sorry mixing together two cases. This one.
I think you should read up on sentencing in NY before you just throw out numbers. Violent B felonies have all different kinds of sentences including flat sentences and indeterminate sentences.

There is an 18 year old kid from a frum family sitting at Rikers now for doing almost the same thing. He ran over 2 people while driving one stolen car and carjacking another.

You're proposing that he be sentences to 25 years. That means you want an 18 year old kid to waste away his prime years for this. What happens when he gets out? He'll be close to 40 with no skills, no job, criminal record. What have you created by imprisoning him for that period of time?

People throw out numbers like they dont mean anything. 25 years for doing something stupid maybe because he was high or drunk and didnt want to get caught?!? Jail is not there to remedy stupid.

He hasnt even started his case. His first appearance was this week. Someone was suggesting 25 years. He is a kid from a frum family who got mixed up with the wrong crowd and ended up on drugs. So was it him or the drugs? First run in with the law. How can you justify 25 years? Someone just threw out that number. Thats playing fast and loose with peoples lives as if a number means nothing.
