I shipped a package with UPS. When I declared the value, I underestimated by $1500. The package was sent as signature required and was never delivered. None of the procedures or requirements for a signature required package of that value (>$10k) were followed.
Originally there was no signature shown as proof of delivery, but after the initial claim was opened, they showed a signature that was clearly bogus. The claim was reopened, a police report was filed, and after a few months they granted the claim but only for the amount in the declared value, not for what we provided invoices for.
Can I take UPS to small claims court for the remaining $1500? I figure that by granting the claim they've agreed they did not deliver the package using the precautions I paid for/requested. If I would not have declared the value, would they be off the hook entirely?
