Title: Watta You Do When Someone Blocks Your Driveway?

Anyone living in Brooklyn knows how annoying it is when someone leaves their car right in front of your driveway for an extended period of time.
Some people leave notes on the windshield requesting that the car not be left there again. I find that not to be effective so today when someone blocked my neighbor's driveway for like the hundredth time I colored all over the windows with window markers:)... hope they learned their lesson:P

Lol. I have a relative that lives in NY that keeps a carton of eggs in the backseat for just that purpose.
But the markers is pretty funny. Did you write anything?

They were all nervous that the person would go crazy, so I wrote "do not block my neighbors driveway as it causes them to borrow mine and leaves me with no place to park". In addition I made all kind of designs^-^

Not sure what heter you had to do that (We pasken אדם עושה דין לעצמו but that only allows you to move the car, not to penalize the owner), you are probably mechuyav to pay whatever it cost to clean and must ask mechila

For those of you that know Lakewood, Satmar is around the corner from my parents house. (the local minyan factory)
People are always blocking our driveway usually partially, so my father started putting stickers on the middle of the windshield so it blocks the view of the driver and usually sliced it into several pieces so it can't be easily removed, and wrote "according to halacha your davining was just pointless as your stealing" or something along those lines and he would put down where it says that.

One time someone totally blocked it as if it didn't even exist, that time I called the police and they ticketed him. (when I called the police I did mention that I am on the local fire dept and he was blocking my car, the cops showed up very quickly)

My father would use a bar of soap to write the "do not block" message. non-damaging but annoying to remove...

Halachicly you may be able to smash his car in order to go out.
You would need that to be less טרחה than calling the owner/police/tow company.

Blocking a driveway (or squatting in a house) for many reasons will not come close to the halachic criteria of גנב (although there are obviously other דיני ממונות)

Calling the police might be a shaileh of mesirah.

The best option is to have a tube or a bottle of shampoo in your trunk.
You can use it to make smiles on the windows, or even write happy purim, why do you block my driveway? Or whatever.
No shailos involved and works wonderful.

Are you serious? Stealing time?????

There is no such thing in halacha. Time is not a monetary object that can be removed from it's owners possession.

Ever hear of a civil court accusing someone of stealing time?

Calling the police might be a shaileh of mesirah.

I wonder if you'd say that if someone was squating in your home... Ask your LOR but R Elyashiv told one of my שבעה קרובים it's not even a question and to go to law enforcement, and this was in E"Y with all the shailos of Dina Dmelachusa and the squatter could end up in jail.

this is the best. A taxi driver in israel got upset i closed his door to hard got out of the car and was a out to start a fight. Anyways every times i see him i am so tempted to throw eggs or do the oil on the windshield.

It's not only drives ways that get blocked , mail boxes that are blocked in occasion will not get their mail .
Which I find very annoying as ppl don't take that into consideration at all!

Contrary to common thought, גזל שינה isn't halchically gezel rather it's a mussar ideal.

No. Halachicaly it doesn't work like that. Even when there is a direct result of an aveira it isn't always a problem, for sure over here.

When I read this I automatically assumed Brooklyn as well! I've been in a rush and needed to park for just 5 minutes and have never ever considered blocking someones driveway. Unfortunately many people lack common courtesy and respect in this world now a days. Personally, I like the motor oil idea.. the eggs is taking it too far as it can cause severe damage to a paint job.

I'm back with my driveway issues...

I didn't plow my driveway from the snow, I just plowed the front of it and I park blocking my own driveway. Can I have a teina if someone is blocking my driveway (claiming the outside isn't mine and I'm anyway not using the driveway)?

I'm sorry, but this has nothing to do with a ticket. Call any tow truck and have it towed.

I actually saw somebody do that on sunday (not a yid), and I thought it was extremely childish. Somebody double parked in front of his car so he expendied a TON more effort to shovel out his car and dump conviently place it on every inch of the car blocking him. It must have taken him a good extra half hour or more.
IMHO whatever effort a person is going to expend on a spot after having dug one out already should be towards a new one. This is the reality of living in a city where you don't own a spot.
[This has nothing to do with OP's question where the area in question is actually to some degree "owned"]

Does anyone else on your block have this problem? Do people realize it's a driveway? I have seen signs by people's driveways saying to not block it.

A. Most of the people I know who have driveways experience the same. Some more some less, depends on the area (I live around the corner of a big Shul).
B. If they don't have vision problems they should. It's quite obvious.

Anyone knows if a driveway has to have a no parking sign in order to be a legal driveway?  I got a ticket for blocking partially someone driveway but it doesn't have a non parking sign.
It doesn't need a sign. The same eyes that can see a sign, can see a driveway. Like a pump doesn't need a sign.

Not to offend you but how did you justify blocking?

Well,  my car was blocking it by just 1 feet,  he had space to get out.
Easy to say that when you're trying to park, but often even that one foot makes it very difficult if not impossible to get out

Not sure about the right thing, but I believe he is legally correct.
I believe all he had to do is give you access to the driveway.
IOWs, its a public spot, but you have "easement" rights.


Think of it this way:
1. You can't park they're on alternate side.
2. The city is responsible for plowing it, not you.

I think in NYC you only aren't allowed to block a driveway if it is an active driveway, but if there are obstructions that make the driveway unusable then you're allowed to.  Not sure if it has to be a permanent obstruction, or a building or what.

That's one option.

Another option is probably extortion, which is to threaten to break their windows repeatedly unless they pay you now.

Needs to be unless they pay you right now, because otherwise when you come back after a few breakings to demand payment, they might have the cops waiting to put you in jail.

I've always assumed I would use this option whenever I've parked in front of an illegal driveway (like the one that had the tree in the middle)

Who do they think they are. Forget about laws - why should he have the spot more then me. either i have it or he does. Its not like im blocking a lot with 30 spots. Why does anyone have the right? and when i say right i mean just as good human. If you take away the curb then the st is loosing a spot so you can have one.
