If the dealer gave money in advance, what exactly is he paying for? I don't see how this can ever be a true kinyan, but I would be very interested to hear if someone asked a rav.

A deposit towards the purchase. The issue with this is logistic, because not everyone who signs up will get a coin, and then good luck trying to get that deposit back from everyone.

But I still think PFS could have handled this way better (not saying they were obligated to) and payed out a bit more to their buyers while still making hefty profits and with that they would have bought themselves customers for life. Instead we have this cr*p show happening now across multiple forum boards (including the Eino Yehudim)...

Who said that they are making such a large spread? Maybe they themselves committed to selling them for $350 or $400 (because they were expecting to purchase them at their agreed price)?

Look, I'm not anything even close to a dayan or posek, so I can't debate it or expound, but that's apparently the case. The buyer missed a step here. Knowing this, the buyer should in future try to do something that obligates the seller al pi halacha - instead of trying to force the halacha to fit into your own parameters.

Meanwhile, everything tells me that yashrus should compel someone who committed to complete the transaction they promised to do. However, we know that when it comes to money negius very often affects a person's sense of yashrus.

Would be interesting to hear what this Dayan suggests that the buyer do next time in order to make the transaction hallachically binding. They can always wait until the buyer has the coin in hand, but then he's just buying it on the open marker. Maybe if the offer is for the coin, plus an small token item that most sellers already have in-hand (a quarter, napkin, writing utensil, etc...)

There's nothing here compelling you to send the coin except keeping your word, which is not a halachik obligation. Need the object to be in the seller's hand and money to be exchanged for the dealer to make even a pseudo-kinyan. That doesn't mean you're off the hook by social standards.

So any pre-orders are not binding halachically speaking, even though both parties agree on a price, and acknowledge that the item is not currently in the seller's possession?

I asked a big Choshen Mishpat Dayan in Lakewood for a psak (I can disclose his name via PM if anyone is interested) and after studying their back and forth emails he said I can 100% back out of my commitment to PFS. I ended up sending my coin anyway to them because I felt that was the right thing to do, but just so everyone knows there are poskim who won't call you all the names that the chashuva members here are calling people with this nisayon.

Personally I will never commit to PFS again after this and I know many others are in the same boat as me so I believe they lost out in the long run for not offering higher value for this coin...

Without providing his name, can you explain the reasoning?

This coin was $60. Its not like a 1400 coin with huge risk.. if buying groups want commitment, they need to pay out based on a market value.

Otherwise people just wont sell to PFS etc.. Good for PFS, they got coins for 200 and mak 1k each? all buyers feel stupid now and wont sell in future.

If they are paying market value, then they donít need any commitments Ahead of time. The point of the deal ahead of the release is the Right to purchase it below market once the item is released, and hopefully realize a profit.

And by the way, if not for PFS and their advertisements I doubt that 1% of the people on this board would even know about this coin.

If I signed a google form that I will sell it to a buying group, not knowing I would be able to get many times over that amount by selling it to individuals. Am I halachially required to sell it to them?

Let's flip it around. If they committed to paying you $200 for the coin, and then the value of the coin unexpectedly plummeted to $20, do you think that they would be halachically required to buy it from you?

The same as with PFS. They can make more money selling to someone else, and neither of their previous buyers will do anything to stop them. Simple as that.

I once called with a question and believe the answer which I was given, and when I HUCA'd, the agent said something like, "oh, I see that you've already inquired about this issue".

I have 8 coins to be shipped with budget shipping. Got confirmation emails on all of them with tracking numbers (it comes from MS) between Friday and Sunday. Only 2 are moving, one started moving today and one shipped Friday. Anybody else in the same boat?
