I’m not a lawyer, but I would imagine chase would be opening a can of really ugly worms if the pattern of shutdowns was even remotely linked to people that opted out.
The theory is not that everyone will get shutdown, just much higher risk of getting AA'd and when/if they do, they'll give you the reasons they give at all AA's.
Even if it's a very small chance that they do this, it is even less likely that I'll have to go to court - just thinking out loud.
