I am still waiting to hear why you would have the upper hand if you sue. There are things like cost, discovery and a counter-suit just to name a couple you open yourself up to taking that route.

It seems like we're not on the same page here. What I'm saying is; if you are able to sue, than when you go into arbitration and they don't appease you, they know you may sue. If Chase bank knows you may sue they will try harder to appease you in arbitration.

That's an easy one: 1) publicity, and the leveraging of the bad kind; 2) timing, the longer they have to deal with you, the more they can't focus on making money or dealing with more pressing issues, 3) appealability, 4) cost (in some contexts), etc.

Not sure what you mean by "cost," but commencing the former will in nearly every instance cost less than the latter, barring some provision in the arb agreement that allocates the entire cost to one party.
