It is my understanding that according to the DMCA, any digital communication that contains information on how to acquire digital content illegally, is prosecutable. I think that's a stretch to conspiracy, and is unconstitutionality. If the media wasn't so heavily impacted I'm sure they would've been running scare headlines for years now, however they all have blackout orders from their parent companies who are all major players in the RIAA/MPAA, so it gets little attention.
As I mentioned above, there are limits and outer boundaries to protected speech. See, e.g., false advertising, hate speech, etc. Now, I'm no First Amendment exegete, but I'd imagine that spouting off about methods to illegally obtain copyrighted digital content likely falls outside the protected realm.
