!WHEN ASKING A QUESTION POST YOUR LOCATION OR OTHERS WILL BE UNABLE TO ASSIST!

You are eligible for the $600 weekly FPUC payment if you are on any sort of unemployment, including PUA and partial unemployment. This is available for claims dated 3/28/20-7/31/20. The federal supplement does not affect eligibility for Medicaid and CHIP. It does affect SNAP and TANF.

If you filed for UI more than a week after your layoff date, you are eligible for backpay.

The obligatory waiting week has been waived, so your claim will process with a date a week earlier than what you apply for, to account for the waiting week waiver.

NY
There is a streamlined application process so that all applicants complete the same form, regardless of which program they'll eventually be eligible for.
PUA:
Unemployment for the self-employed. Acceptable proof of income includes prior year tax returns, 1099, P&L, bank statements and more. You will most likely be approved for standard UI even if you're an independent contractor, if you had W2 employment within the last 18 months.
If you are assigned the minimum rate of $182 when it should be higher based on your income, complete this form, fax it in, then send it again via the message center (Subject1: "Benefit Rate and Monetary Determination" Subject2: "Some of my wages are missing or incorrect") so that they definitely got it. Your rate should be adjusted in less than a week. You are also entitled to get your updated rate on all prior weeks.
You are also eligible for PUA if you landed a job but where unable to start due to the pandemic. You need an employment offer that was then rescinded to prove this.
PUA is available for a total of 46 weeks from 02/02/20-12/31/20.
Partial UI:
You can apply for partial UI if you're working 3 days or less, and earning $504/weekly or less. The DOL deducts 25% of your base rate for every day that you work. (You receive 100% of your rate if you don't work at all, 75% if you work 1 day, 50% if you work 2 days, and 25% if you work 3 days).
PEUC:
For those on regular unemployment- you will receive an additional 13 weeks of benefits after you've exhausted your initial 26 weeks. This benefit is available through 12/31/20.
Extended Benefits:
For those on regular unemployment- you will receive an additional 20 weeks of benefits after you've exhausted your initial 26 weeks and your PEUC weeks. This makes for a total of 59 weeks that you can possible receive unemployment benefits. This benefit is available as long as the state's unemployment rate is high.
Requesting Backpay:
The NY DOL is using Docusign to allow claimants to file backpay. You should receive an email from the DOL with instructions. The email subject is "Action Required - NYS DOL Certification for Back Week Payments". This might end up in your spam folder, so be sure to check that as well.
If you don't receive this email or you don't want to wait, call the NY DOL and speak to an agent to certify for backpay over the phone.
It takes a little less than a week from when you complete backdated certifications until your claims are processed and funds are released.

NJ
Apply here.
PUA:

At this point it looks like claimants are still being given $231- the minimum PUA rate- regardless of prior income.

Partial UI:
You can apply for partial UI if your hours have been reduced by 20% or more. You'll be allowed to earn an additional 20% above your rate determination. Your earnings will then be deducted from your rate, and you'll receive the balance as your UI payment.

I don't know if they tried calling, I'll ask... does it make a difference if you call them from a NY area code or not? I believe this person has a non-NY cellphone number. Should they borrow someone else's phone, or set up a Google Voice account? Or no need?

A few weeks back when it was very easy to reach an agent there were clearly hold times for those calling from out-of-state area codes. Now that locals are having a hard time too more often then not, it's hard to tell.

Yes, that would be considered an SE gig except that it's recorded on line 1 (usually reserved for W2) on the tax return with HSH as the memo.
Did they file it on their 2019 return?

I've been doing some more research into the definition of "good cause" for a voluntary quit (those who quit voluntarily are not generally eligible for unemployment without good cause).

Section 593 of the Unemployment Insurance Law
Compelling family reason- includes but is not limited to: domestic violence, illness or disability of an immediate family member, relocation due to spouse's employment.
Marriage is not an accepted reason for a voluntary quit.
It is possible that quitting due to the need for extended maternity leave would be considered "good cause" under the allowance to quit for "illness or disability of an immediate family member".

A reputable NY law firm published this article in 2016 which includes taking care of children as a "good cause" reason as well, along with many others.

Correct. Since most employers are not willing to grant an extended leave of absence as is sometimes required for a difficult pregnancy or birth, this shouldn't be an issue for most.

Did you try to call? I've seen a trend with claims on hold, that when you enter your SSN in the automated system you automatically get routed to an agent- I'm assuming it's because the system picks up on your hold claim status.

Chances are they need to verify your past employer or something similar before they can release your claim.

Okay, I asked if an attempt was made to call the DOL. Here's the response I got:

"Yeah, I called them today. Put in my SSN and somebody picked up after less than a minute. LOL.

Anyway, they went over the UI application details with me (basically, asked me all the exact same questions as when I signed up online - dunno what the point was of doing it again) and then said "okay, we're done, now we're gonna transfer you to PUA." They transferred me to an automated system that asked a few basic questions - how much was your income last year, etc. - and then proceeded to go into a loop: the automated system made me certify TWENTY WEEKS, one after another, one at a time, listening to and answering the same five questions over and over and over and over and over and over again. Took the better part of an hour! When it was done, the automated system told me that it was "successfully submitted", or something like that, and hung up on me.

Does that mean I'm good to go, that I'm approved, or do I have to wait for an official email of approval? And once I'm approved, will I have to "certify" everything again (I heard from some people that they got a docusign for 10 weeks, and then had to submit for the rest of the missing weeks by secure message), or does the excruciating hour that I spent on the phone with the automated system mean that once approved, everything will be paid out and at least I won't need to certify again?"


Any insight?

He should see an update in his account with a benefit rate of at least $182 within a day or two.
If those 21 weeks were actually recorded or not is a hit or miss... if his Effective Days doesn't drop from 104 to ~20 within a week, he'll need to call in or message to certify for those weeks again :o

However, if I click Go To My Inbox, the last message was sent 7/16.

Can anyone help me? They told me they escalated my inquiry in early July and should take within 10 days.. no response.
Basically I applied 4/19 but then got a 1 time payment on may 15th from PPP funds paid to my employer (Im on a 1099), so I put it in when I was certifying for that week and it errored my account.

I don't have any advice on your UI claim, but if you're 1099 you can get your own PPP and you shouldn't have been paid from your employer's PPP.

The PPP deadline is this Saturday, August 8.

I had at least 10 people reach out today who didn't realize they were eligible. It seems that this is most common with individuals who have a 1099 and are not aware that that translates as a Schedule C on their return (and that they are sole props because of it).

I know that it's not possible to get the message out to everyone, but if you know someone who has a 1099 (or if you want to be bolder a business that issues 1099s) be so kind as to inform them of the possibility of PPP eligibility. All it takes is a few seconds to check if your 2019 Schedule C has positive income on line 31.

I'm taking PPP eligibility questions at chaiplus1@gmail.com so feel free to point them in my direction.

Its the reply that you sent them on their message. You could see it by sent messages. I have seen this a lot.
If it benefits even just one fellow DDFer, its worth posting it.

I don't understand why NJ just doesn't care. People are waiting a long time for unemployment to be able to feed their kids and pay their rent.
