Halachic questions and issues
« on: April 05, 2020, 02:30:06 PM »
All this social distancing has created lots of novel halachic issues and questions that don't come up when you can just take your shul for granted, not to mention with Pesach approaching and issues like tevilas keilim, mechiras chometz without a kinyan, etc. I figured this would be a good place to use the situation as a learning opportunity.

I'll start with Krias HaTorah. Just before the first Shabbos we davened at home, two well-known Flatbush shuls sent out to their email lists various guidelines for a Shabbos davening at home. One of them said clearly that we should lein the parsha and Haftorah as best we can (from a Tanach or Tikkun?), while the other advised doing so and added "she'lo min hachiyuv." Has anyone looked into the halachic issues of this and has any mareh mekomos/shittos/p'sakim to share?

Also, to the extent that one should do so, does it also apply to Haftorah, Shabbos mincha, Monday and Thursday mornings, taanis (hopefully no longer applicable by 17 Tammuz)?

And once we BE"H soon return to shul, will it be the longest davening ever with the longest leining ever as we make up all the parshiyos that we missed, or those from the present sefer that we missed, or from the previous week, or no tashlumin? Again, sources would be helpful and appreciated.

And another question that came up that by this point is hopefully l'halacha v'lo l'maaseh is for those who made (past tense!) outdoor and backyard minyanim, what are the halachic requirements for the 10 to be considered joined together as a minyan? As I understand it, they must be able to see one another, but do all 10 have to be able to see all 10, or is it enough if one can, or the chazzan, or ...? Also, are there any specified shiurim about how far apart they can be and still be considered part of one minyan that's allowed to say devarim she'bikedusha together?

An extension of this question is when is the proper time to do shnayim mikra?

Appearently Tashlumin is just for shabbos morning Kriah of the whole Parsha.
For if and how to do Tashlumin, see סימן קלה ס׳׳ב ומשנ׳׳ב שם, and take it from there.

Tough questions like these need to be asked from a real Posek.

"Im hatzibur" means on the same schedule than the tzibur, each week on it's parsha, not creating an individual schedule.

Rav Shmuel Kamenetzky shlita is quoted on the second question as saying, "Even if you lost your sense of taste, you may still make the brachos “al achilas matza” & “al achilas maror.”

What were anonymous online forums created for if not for this?

While I wouldn't want to rely on an anonymous post for halachic guidance we can still have the discussion להגדיל תורה ולהאדירה

Exactly. So what is considered im hatzibur? There is currently no tzibur claiming, so what makes today shemini for example? Perhaps the tzibur is still up to vayakhel.

That's comical.. The seder goes on. And there are plenty of kehilos around the globe who still read with manyan every week.
