I didn't watch either. What I did see is the defense attorney complaining there was "black" pastors in the audience and wanted them removed. You can't make these things up!!!

Lol, he's repeating the motion every day, and now he asked the judge to stop protestors outside from chanting "I stand with black pastors" as that may affect witnesses (not the jury).

He keeps digging, "There was an individual in the hallway during lunch wearing a black lives matter mask".

Closing arguments today. Haven't been paying as close attention, but it has been interesting to note the differences in reaction to the Rittenhouse trial. I don't know that the jury will convict, the citizen's arrest law might be just enough of a sticking point to provide "reasonable doubt", and you can never know what a jury will do. But in public opinion, it's difficult to find people who are on the defense's side. Even with the citizen's arrest law, it seems like everyone is in agreement that these people are guilty as sin. If everyone or the system was as racist as the Rittenhouse rhetoric would have you believe, why aren't there hundreds of thousands of viewers on conservative live feeds calling for acquittal? Am I wrong? Is there a massive movement following the case convinced of the defendant's innocence?

In the KR case you can make your argument for him without seeming to be a racist. In this case I just don't see it.

Hearing the judge's charge regarding a citizen's arrest, the defense has no case to me. I honestly don't see a way for an acquittal for Travis and Greg (I could see the jury going easier on Bryan)

Disgusting.
We should not group everyone or areas into one group. When you see example after example it is hard not to.

But who goes jogging with no socks and toes out?
This is a defense lawyer that will do whatever possible to get her client to walk, this made a stink and got folks more interested.

Honestly, I didn't think it was racist (is there some kind of dirty toenail stereotype I'm not aware of?), just weirdly off putting. If memory serves, she didn't even explain the line to mean he wasn't wearing jogging attire. It came across as a desperate attempt to try find a way to paint Arbery in bad light when she had nothing to work with.

What felony was committed @KSMH

2010 Georgia Code
TITLE 17 - CRIMINAL PROCEDURE
CHAPTER 4 - ARREST OF PERSONS
ARTICLE 4 - ARREST BY PRIVATE PERSONS
17-4-60 - Grounds for arrest
O.C.G.A. 17-4-60 (2010)
17-4-60. Grounds for arrest

A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.

The defense argued that they had probable cause to suspect felony burglary.

The state seems to be arguing that probable cause is not enough, because of the first line of the law. The judge did not clarify to the jury which interpretation of the law is correct. I wonder if that will be grounds for appeal.

SHOCKER!

Apparently was not mentioned at trial. Not sure if that is because of the rules of evidence, or because of the lack of evidence that it ever happened.

Apparently they tried to make this argument through testimony, but if that was her intent, then she should have said it clearly on closing

The state argued "If the offense is a felony and the offender is escaping or attempting to escape". He admitted on the stand he was not aware of any crime he committed. How can one escape a felony when no crime was committed? The prosecution blew the citizen arrest out of the water.

I believe you are mistaken. This was a massive sticking point in the jury instruction argument, and the defense said the judge's instructions were giving the jury a directed verdict of guilt.

The judge said immidiate knowledge and in his presence are synonymous. The judge further said that if the arrest is not made immidiately, the right to arrest is extinguished.

That's why at first I said they may be enough for reasonable doubt, and then changed to me not seeing a way to acquit at all. They have no evidence they were chasing him for any immidiate crime, let alone a felony.

The grounds for appeal would be if the judge got the instruction wrong, but I have no knowledge of the likelihood of that

That once you have probable cause for a felony arrest, you can make the arrest if the suspect is fleeing, no matter when the fleeing is happening.

The judge said immediate knowledge and in his presence are synonymous.

Irrelevant according to the defense's argument, because that first line is not talking about when the crime alleged is a felony.

The judge further said that if the arrest is not made immediately, the right to arrest is extinguished.

Then what does "and the offender is escaping or attempting to escape" mean?

The language of the law is pretty clear that for a felony that is not required, only "reasonable and probable grounds of suspicion.."
