Its possible to go to monthly payment plan without a contract and without losing unlimited data.  In theory the account doesn't close right away, you could cancel and get out of contract and then reinstate the service before it disconnects but before the close the contract.  But it would be a pain and fairly risky.

because the change in terms only entitles you to break the contract (at no penalty) within 30 days, not be 'absolved' from it. if you keep the same deal-even under the new terms-on a month to month basis, you essentially accepted the new terms. so you have to get the penalty waived under the premise of canceling now, and then 'forget' to actually cancel. which is the same thing as switching to month-to-month right away.

After speaking to several Verizon CSRs and all of them refusing to cancel any of my contracts one CSR finally explained why Verizon is not obligated to cancel even though they are changing the regulatory fee. She said that nowhere in the contract does it mention the price of the regulatory fee; it only mentions the fact that there is one. And since there is no set $ amount for the regulatory fee they can change it as they wish without being in violation of the contract.

She said that nowhere in the contract does it mention the price of the regulatory fee; it only mentions the fact that there is one. And since there is no set $ amount for the regulatory fee they can change it as they wish without being in violation of the contract.

Its not going to be easy.  You could have your lawyer call in for you and have him explain it to them. The CSR have been coached prior to your call about the fee and have been lied to. Its your job to know the law and the Customer agreement better than them. I gave the reference's. Show him the truth.

The only reference I saw was the one mentioning that the regulatory fee is going up. But that is OK; they are allowed to raise it> Nowhere in my contract did Verizon and I agree on a price for the regulatory fee, we simply agreed that I would pay one - whatever the cost.

So they can raise it by $1,000/month and you're still stuck with your contract?
That argument does not hold water.  You signed at contract when the fee was one price and now they have raised the price.
Now they can argue that .03/month is simply not material, and that may be a valid argument...

Theoretically, yes they can.
Of course there are various other reasons that they cannot or would not do that. But if your question is if they would be in violation of the regulatory fee clause of the contract for raising the regulatory fee to $1,000 - the answer is no.

Quote from: Customer Agreement
We may change prices or any other term of your Service or this agreement at any time,but we'll provide notice first, including written notice if you have Postpay Service. If you use your Service after the change takes effect, that means you're accepting the change. If you're a Postpay customer and a change to your Plan or this agreement has a material adverse effect on you, you can cancel the line of Service that has been affected within 60 days of receiving the notice with no early termination fee.

As you can see above it is not only a change to the agreement but also to the plan and I am pretty sure the Regulatory Charge is part of your plan and as such it falls under the above clause...
