Rear end collision while double parked
« on: December 05, 2021, 10:19:36 AM »
Was double parked while trying to park/drop someone off, car rear ended from behind, minor bumper damage ( 2 holes from license plate and scratches). This is in NYC.
Do i need to report accident? (i know it says over 1k- not sure if this falls under)
Who is at fault? will insurance go up if i make a claim? We both have same insurance company..

The 'at fault' person will have it held against him.
If he's willing to pay for the damage, you can go completely off the grid on this.  Otherwise, report it to your insurer. They'll hear both sides and make the determination.

Imho do not do this!!!
Go straight to the at fault person's insurance. Why let your insurance know?

But obviously best thing is to deal with it keeping insurance out of it.

I know forsure when pulling out of a parking spot (parallel parking), you're at fault in NY because the other person has the right of way.
In your scenario being double parked I'm not sure.

I've heard that being hit while double parked in ny isn't so clear cut the other person's fault.

How is it worse then when the guy short stopped in front of him. When it's ALWAYS the guy behind fault
