Check the date. There used to be a double standard that was overturned in court and that’s why shuls were not more limited than other gatherings. If aguda somehow gets the courts to rule that zip code based restrictions are unconstitutional the government will simply find another way to accomplish the same measures.
In simpler terms. They had a way to single us out but that was deemed unconstitutional so they switched to zip codes. And once zip codes are also argued then they will find another way to single us out?

Incorrect. In simpler terms, they were forced to have the same guidelines for shuls as they would for other similar situations. To my knowledge they have followed that ruling since then, including here. Some want to argue that restricting zip codes based on positivity rates is also discrimination against Jews but I fail to see how that is a coherent argument.

This may give you some idea of why it may be discrimination.

Quote
If the federal government were to properly exercise one of its enumerated powers to institute a nationwide order, Smith suggests that, so long as the order is generally applicable and neutral with respect to religion, it could be applied to religious gatherings without violating the Free Exercise Clause. The constitutionality of any such action may, however, still depend on whether religious gatherings are treated similarly to other types of nonreligious activities

IOW, this may give you an idea why it should not be considered discrimination.
