They are all using a broad brush to what constitutes comparable secular activities.

Yea that's the only thing that may change. Because who has a problem with him limiting supermarkets and banks, NY'ers are willing, able and ready to bear with it, he sure has a free pass for that too. So basically there is no real change here ::) ::)
In Willi BP Monsey it anyway doesnt matter as we are following already the constitution for a few months.... The main takeaway from this ruling is that Lord Cuomo is not the boss anymore.

Aside from all the things he said publicly and the makeup of the zones, his defense in court was that it couldn't be anti - Ultra Orthodox because he didn't make Crown Heights and Williamsburg red zones. Except the Jewish stores in ch had multiple inspections daily, with many, many unjustifiable fines, while non Jewish stores in the same streets, in the same zip codes where not inspected. It was blatant.

It’s funny how people here ridiculed the agudah for bringing the lawsuit in the first place and now seem to be in denial as to the results of the injunction. Cuomo lost, plain and simple. As much as him and his cronies cry about how terrible SCOTUS is, they slapped him in the face and he has zero recourse.

The District Court noted that “there ha[d] not been any COVID–19 outbreak in any of the Diocese’s churches since they reopened,” and it praised the Diocese’s record in combatting the spreadof the disease. ___ F. Supp. 3d ___, ___, 2020 WL 6120167, *2 (EDNY, Oct. 16, 2020). It found that the Diocese had been constantly “ahead of the curve, enforcing strictersafety protocols than the State required.” Ibid. Similarly,Agudath Israel notes that “[t]he Governor does not dispute that [it] ha rigorously implemented and adhered to allhealth protocols and that there has been no outbreak of COVID–19 in [its] congregations.” Application in No.20A90, at 36.
Not only is there no evidence that the applicants havecontributed to the spread of COVID–19 but there are manyother less restrictive rules that could be adopted to minimize the risk to those attending religious services. Amongother things, the maximum attendance at a religious service could be tied to the size of the church or synagogue. Almost all of the 26 Diocese churches immediately affected by the Executive Order can seat at least 500 people, about14 can accommodate at least 700, and 2 can seat over 1,000. Similarly, Agudath Israel of Kew Garden Hills can seat up to 400. It is hard to believe that admitting more than 10 people to a 1,000–seat church or 400–seat synagogue would create a more serious health risk than the many other activities that the State allows.
