Scenarios Where SCOTUS Can Decide The Election

1. If PA is the decisive state, Biden wins it with ballots that arrive between Nov 3 & 6, and SCOTUS decides to revisit their 4-4 ruling which allowed PA to accept them (Trump is fighting for this)

2. If Texas is the decisive state (all but impossible) and it's decided by the 127,000 Harris County Drive Through Early Voting Polls that are currently on appeal at the 5th circuit.

3. If any swings states have very close results and there is a dispute about recounting.

Any other potential eventualities?

Jonathon Turly said on Fox that there are about 400 lawsuits filed about the election. Most will probably be moot by tonight, but it's fair to say that there may be additional challenges than the ones mentioned above.

There are also cases pending in NC, MN, and perhaps others. In WI they already invalidated a Judge's order that changed election law to allow votes that arrived late to count.

There is a difference between denying a requested injunction and deciding one way or another.

Details of pending cases? Didn't SCOTUS 5-3 allow NC to count ballots received until Nov 12?

There are 3 types of cases
1 - Cases in which state government (either the governor or the board of elections) changed the rules.
2 - Cases in which the State courts changed the rules.
3 - Cases in which Federal courts changed the rules.

FWIU SCOTUS only gave an opinion on the third (saying that Federal courts should not mix in so close to elections)

Right. My point was just that it wouldn't be "revisiting" that decision. It would be a ruling on the merits of the case.

I don't think there is any way to do that for votes that have already been counted. Even if you find out someone who should not have voted did, you have no way of knowing which ballot is theirs.

What percentage of first class mail gets lost in general? Also, someone posted an article in which the USPS claimed that some ballots were expedited manually and therefore wouldn't have been scanned.
