I find it interesting that by the Al Smith Dinner of 2012, days before the election, both Obama and Romney made fun of Joe Biden.

Romney: "I was actually hoping the president would bring Joe Biden along this evening because he'll laugh at anything."

Obama: "It’s been four years since I was last at the Al Smith Dinner. And I have to admit some things have changed since then. I've heard some people say, "Barack, you're not as young as you used to be. Where's that golden smile? Where's that pep in your step?" And I say, "Settle down, Joe, I'm trying to run a Cabinet meeting." (Laughter.) He does smile when he says it, though." (Laughter.)

I find the wording "It would be one thing if Congress had specifically authorized the action that the CDC has taken." interesting, to me it sounds like even if Congress did authorize such an action it would still be questionable if it would pass muster.

That is correct because evictions are intrastate and typically under state jurisdiction.
