CMIIW Igros Moshe 166 in the last line of the tshuva says that according to him vocal is mutar on radio (recorded?) but instrumental is assur. And for sefira (presumably 3 weeks as well), those who are matir radio (recorded?) instrumental the whole year, would assur. Which indicates to me that vocal is mutar according to those who are matir radio instrumental the whole year.

That is a nice shtickle torah but not a source. It can easily be because for sfira and bein hamitzorim none of this makes a difference at all since it is not a gezeira comparing to the music of the leviiim.

Yes and yes. He also says that someone who is so "into music" that he is looking to get around the rules for sefira and bein hametzorim ismore of a reason to be assur the whole year.

Thanks. This R Kleinman was the one last year saying new tissues may be a shaila during the 9 days? Is he an accepted posek (with mesorah/shimush) or he's a chashuv yungerman saying shticklech torah?

Yes I know that about him. He has shimush by R Shmuel? R Shmuel is a posek? (I know he's a very well respected ziknei Rosh Yeshiva - gedolei lita in america, but that doesn't necessarily mean he's a posek, for ex. BMG has roshei yeshiva and poskim - separate positions). Just b/c he put together the kovetz halachos doesn't necessarily mean he's a posek, there's KH many many sforim coming out from yungeleit of their Rosh yeshiva's torah's etc all the time...

It's very possible this hinges on a much more involved question about derech hapsak which I'm not particularly interested in getting into ATM.

It's a relatively new phenomenon that a R"Y isn't a posek. If someone of R Shmuels caliber is confident enough to give a psak, I would be comfortable following it.

Just like by chassidim there was a Rebbe for spiritual guidance etc and a Ruv for psak, by litvish there was a Posek/Dayan for psak and R"Y for guidance... There may have been a number (many?) situations where those lines crossed but that wasn't the default.

Source back at you. Look at Yeshiva Torah Vodaas and MTJ among others. Go to Europe and you can find the same thing. The Noda Biyehuda and Chasam Sofer both had yeshivos.


Bottom line is that in halacha there is no mention of musical instruments regarding sefira or bein hamitzorim. To be matir is olecho raaya lihovi.

Not sure I quite understand? Do you mean to say that Halacha forbids music during the 3 weeks/sefira and to be matir a certain type of music (such as vocal) is olecha lehovi raaya?
