I am saying when he first shot Rosenbaum he was not touching KR or his gun. He never touch KR and if he touch the gun it is in dispute. If he did touch the gun it was after he shot him once.

I did not listen to the ME testimony, and I don't think it's relevant. I'm simply discussing the prosecutor making a distinction between touching his body and touching the gun. I'm not discussing what happened because it's irrelevant. When KR responded that he touched his gun, the prosecutor didn't accuse him of lying, he just said he's not asking about the gun and wants an answer about his body. He was trying to paint a picture that KR wasn't touched even though he's not disputing that KRs gun was touched.

He refused to answer the question. He was being evasive and that looks bad.
Yes the prosecution will/should dispute the gun was touched especially for the first shot. The evidence is overwhelming at that point the gun was never touched. Expect him to make that point in closing.
