What happens if the tenant refuses to agree to the increase? Not sure about eviction being an option for "illegal" basements.
What happens when a parent is able to but refuses to pay their tuition bill because they don’t like the increase? Either pay up or get a halachic psak that you are not required to pay. Or switch to a different religion that lets you steal if you feel justified.

If the basements are not 'legal' does one still have to follow 'legal' rent increase limits?

I was specifically responding to the question that was asking from a strictly legal perspective.

I personally know of at least two instances in the last couple of years where landlords  have got into trouble because of basement tenants.

in one instance a 5 figured fine, in another the landlord was alerted that there would be an inspection. The postal worker had alerted authorities because the landlord decided to put up a second mailbox for his tenant. Upon receiving the notice he contacted a "certain" person, and long story short he paid someone a few bucks, a *wink wink* inspection occurred, and it went away.

Legal means registered as a two family and the basement is up to code. The fact that it's a basement is no longer a problem.

As far as I know, the only authority would be the Lakewood inspection dept. It seems really strange that they would pick one random basement to go after with a 5 figure fine

(1) There is a person (family) on the other side of the transaction, to whom it will cause financial and/or emotional distress
(2) It an essential item (not a luxury or discretionary item)
(3) Not to push a guy/family out of kollel
(4) The tenant is usually in a weaker financial position
How about where the landlord is in Kollel with a large family while the tenant & spouse are both working and have a small family?
