What do you mean by legal. If the question is will you go to jail, the answer is it's not a criminal offense. It's a breach of contract. To my understanding there is much debate if a person is required to keep a contract legally, or if he can break it as long as he abides by the consequences of the contract. Either way it would not be ethical to break the contract

FWIU legally you are not required to keep these t&c and they would not be allowed to take away your miles if you sell, however they get away with it by saying that you never own the miles and they always belong to the airline so you have no way to go back to claim them
I wonder what people who type "u" instead of "you" do with all their free time.

In that case, is it ethical to sell someone something that doesn't belong to you?

I've never heard of such a ruling. Can you ask your Rov for a citation or where he heard about it?

Because the t&c are not legally binding
Why?And therefore what?
They get away with taking away miles thru an unrelated technicality that you never own the miles, not because you violated the t&c which is the reason you have no legal recourse if your miles are taken away even if you did not violate the t&c (like Rabbi Binyomin Ginsburg)
I wonder what people who type "u" instead of "you" do with all their free time.

Even though they have a way to take away your miles doesn't mean you need to listen to their rules

If the miles belong to them then why do they issue 1099s when they give miles for reasons other than rebates?

He heard it from a well known Choshen Mishpat dayan who spoke to a lawyer. I doubt I'd be able to trace it.

I Googled it at the time, and there was a lawsuit, but I couldn't find the verdict.

The miles buyers are quite public, and claim on their websites that it's legal, so I'm inclined to think it is.

There was a lawsuit -
Allison Haas, et al v. Delta Air Lines Inc., United States District Court, Southern District of New York, Case No. 03 CV- 0589 - which apparently settled. IDK if this is what he was referring to.
