Should I ticket the vehicle owner who blocks my driveway?
« on: January 31, 2022, 08:57:24 AM »
I live in Brooklyn and if you don't already know finding a spot is like finding a needle in a haystack.
But BH I can't complain even with the few cars at home, we have a private driveway which allows us to park one in the driveway and one blocking it. And then if we still need another spot or two, we have the best neighbor there is to have, where we can park for short term. who allow us to park there as well, as they own a private driveway.

Now comes to the purpose of me creating this thread.
So with all that being said you are bound to have multiple visitors throughout the day who feel the right to park as they please in front of my driveway.

Now if I happen to be away and you parked there, good for you. But should I have to come home from work and need to circle 10 times because one clown decided to block my driveway then I feel sorry because I'm going to have you ticketed.
Now with all the excuses oh I'm sorry. I couldn't find any spots or it was just for a few minutes...or the latest this very morning as I'm typing this. There's snow banks everywhere, my driveway of course I didn't shovel out. As I'm using the front to block it for now vs me clearing the length of the driveway.
So whatever cockamamie excuse this guy has I just don't see how it will justify me having to spend 10 minutes finding an alternate spot and shlepping through the snow to get home and if I have a packages to bring in later will make it a real pita.

What's your guys take on this? How would you proceed?

Yes I have a big sign that says it's a private driveway please do not block. Active driveway.
Yes almost every time its a different individual, so not sure that little paper on the windshield will help. And the next time what will go through their head oh you need a spot? over there you get a paper for parking so if you really need go there.
And you can clearly turn your head to see there's a private driveway.
Let alone the other stories when owning a private driveway. I remember more than once where violators were caught red handed relieving themselves.. story on its own for a different time.

This came up in chosen mishpat, and while not necessarily the recommended approach, you can halachicaly take any means necessary to move the car out of the way. If that means removing the bumper so be it. I'd call a tow truck if I were you. People don't learn until it hurts.

I would do that. Though I was thinking that might be a bit to harsh because I think a ticket alone is for $115.
So I'm hoping that's a lesson that will stick at least for a few months before thinking to come back and visit.

How about a sign next to your no parking sign.

"To date people who parked here have paid $4,568 in towing expenses, do you want to be next?"

"This parking space is approved by Ron's Towing Co. Please Park here my kid needs braces"

And others I'm sure you can think of ;)

The problem is , that unfortunate there are a lot of so called "private driveways" that people made for them selfs but it's clearly not a legal driveway, Boro park is loaded with those kind of driveways , and people are fed up with it , and thinking that almost any driveway is probably not legal. If your driveway is indeed legal, you need to come up with some sign to make it clear for the visitor that your driveway is legal and that they will pay the consequences even if they park for a few minutes.

Legal or illegal, how would the person parking in front of it know?

Meh, those all come off easy. Anyone with half a brain either does the slow pull, or the hot water pull and they come right off. I've done that to many card at my office lot. Rarely was it a deterrent.

Yes I don't have an illegal car port like what you're thinking of. It's a full fledged driveway with a garage in the back if that helps you understand what specific type of driveway I'm referring to.

I love this idea. I'm going to work on something to this effect.
I guess instead of cars in the near future It will become a popular sight seeing. Many to come photograph that new sign.

Yup that's my current plan. Though I do feel bad to some extend causing someone else a loss. But then again on the flip side.

Yes many times or rather most times its goyim, while there's  a nice percentage of frum ppl, and who feel embarrassed when I'm waiting outside and they show up. They start blabbering every reason why they were allowed to park there or at least try to justify their wrongdoing.

My in-laws in BP have this all the time, most of they time they let it go (there was a time when someone blocked it for over 24 hours :o and they had them ticketed). What I like to do is double park blocking them and this way they need to knock on the door and the conversation usually goes something like this.

Me: Who is it?
Mr Blocker: Someone is block my car
Me: Oh really, that must be a PITA ;D

I had a similar situation a year or two ago.  I called 3-1-1.  They started going through a laundry list of things to do. I asked if I could call a tow truck, they said sure.  When I called the tow company, they said they can't legally tow unless the car has been ticketed. It was Xmas eve, and the police had no interest in coming over.  Instead, we gave them the plate number, and they called the person.  Took probably an hour or so to get the car moved---too long to get the kids to school; they had to be walked.

Maybe time to invest in a few of these? You don't even have to use them. Just hang some up in front of the house with a sign: "Cars that park here are given a car boot, free of charge" and "Quick boot removal available here, only $350"

All the solutions that "punish" the driver won't solve the problem, because, as you said, it is different individuals every time.

I just saw a sign yesterday where someone specifically writes LEGAL driveway.
A non-standard no parking sign with the right warning hopefully should help.
One I've seen, although it came with financial repercussions was
"Don't even think of parking here, not even for a minute"
Maybe have visible cameras and have a line "you are being watched/monitored".
People might act differently if they know they are seen, even if it doesn't have repercussions.

The solution to this issue is a different thread that @Dan loves to reference.
