Cancelled
« on: August 22, 2022, 11:04:59 AM »
I took everything out of the cuboards from 3 rooms, so that the painter (jewish)could start his job at 8:00 this morning. At 7:20 he sends me a sms that something happened and that in the meantime he will not be doing it.When we phoned he said his car broke down. Now I don't trust him, the way he sent his message. He wants us to pay for the paint. What's the halocho here?

Would you at least get to keep the paint and give it to the next painter you hire to paint with?

If he’s still offering to do the job, and he purchased the paint for it, it doesn’t seem right to force him to keep the paint because of your sense of “mistrust”.

Did you cancel on him or did he cancel on you? From your story, it sounds like he postponed, and you cancelled. At this point, while not penalizing you for cancelling the job, he's requiring you to pay for the materials procured on your behalf.

The painter can always go and return the paint, or use it by a different client of his. If he was a responsible person, he would have found some other way of getting to the client's location, but he did not show up at all - so he shows that he does not value your time. Always do your research, find online reviews, get references - do not blindly trust anybody, and do not pre-pay.

My landlord put a deposit with a painter,  who was contacted to paint an entire house -- he showed up for 3 days, and then disappeared for an entire month because the painter found a better paying contract somewhere else!

so many assumptions here:
The painter can always go and return the paint,
who said?
or use it by a different client of his.
who said?
If he was a responsible person, he would have found some other way of getting to the client's location,
no. if your car with all your messy equipment breaks down you can't just move it all to a new car...
but he did not show up at all
not necessarily, hes coming tomorrow or the next...
- so he shows that he does not value your time.
no that his car broke down...
Always do your research, find online reviews, get references
maybe he did...
- do not blindly trust anybody, and do not pre-pay.
he didn't, the guys asking for money for the paint

Paint stores will not refund custom colors and who says a different client of his wants the right amount of that color?

If he is a business customer many paint stores (Sherwin-Williams) will take the paint back.
Only on DDF does 24/6 mean 24/5/half/half

Paint is not returnable because they add specific colors.

We'll be paying the paint. It's the classic off white.
He knew I emptied out a three room flat. To leave a message a half-an-hour before starting,"We have a glitch, in the meantime we cannot come. We thank you for your understanding"
thenafter we phoned asking the meaning of this, he said the car broke down.  I just don't believe it. Doesn't sound like sometime who really wants to do his job.
