How to go about a product invention?
« on: August 31, 2022, 08:47:01 PM »
There are great ideas that come up from time to time. I have a product invention idea for the food industry. Any tips or suggestions of how to go about such a thing.

Not sure if you meant that specific post or just the general thread?

this post seems more relevant
Process I would follow -
Find a reliable patent lawyer/agent to consult with regarding patentability
Hire industrial designer (freelance) to create 3D CAD models and samples
Search Alibaba for reputable factories within that niche
Once you have costing/factory sample and it makes sense to produce, file a utility (and optionally a design) patent
Produce the goods

PM for further help but I am bit busier these days

That thread is for sharing ideas. Not interested in that. Just how to go about producing a idea

Yes, but there do seem to be some genuine leads for materializing ideas on that thread such as:

Process I would follow -
Find a reliable patent lawyer/agent to consult with regarding patentability

Or

Don’t know anything about them but be careful- if you don’t have personal references stay away. There are many stories of places like this stealing any good ideas they hear. Probably worth it to speak to a patent lawyer first and foremost. Not much. I’ve spoken to a patent lawyer a couple of times, I can give you his number if you’d like. Frum guy.

and more if you dig through the thread a bit

You don’t need a patent to start off. Many ideas are not patentable and you don’t know if it will succeed. If anything I would just do a provisional patent, which should not cost much and only after I did the product design and molding process.

I have many ideas, great ideas (yes, even I say so myself), but mostly in the tech industry and that doesn't require the hardware part which is prohibitI've.
On the other hand, it really can't be patented, only Trademarked.
My missing factors are:
Living in a not start-up friendly place, but it could be bypassed.
Money, not too much.
An honest partner, preferably who can help with the above and doesn't grow tired when things take a while, but would give a virtual shoulder tap every now and then.

It's a lonely route.

Correct, my response was to someone who wanted a patent. Also if the product is for Amazon, I would rather start with a utility/design patent instead of provisional, otherwise if successful your product will get knocked off much faster than you can shut them down.

Regarding patentability- you want to consult with a lawyer or patent expert before starting the design process, will avoid a lot of headache in the future. You don’t want to find out after your design is done that you’re infringing on some unknown product, or that you won’t have any IP to give you a unique market advantage.

Impossible for someone to tell how to go about something when you don’t tell them what it’s about, if you think it’s a good idea and don’t want to shear the info… speak to someone in that industry who you trust and they will be able to help you to the next step…

When you have an idea in the industry your in and it’s practical you usually know how to proceed to the next step.

My 2 cents.

good points. Generally starting a new product takes a lot of capital. So one need to prioritize and sales is the key to success and where most of the effort should be placed. Getting a utility patent can cost 15-20k ( I am sure you can find for less ) and you will still need to wait two years till it’s approved. You can get a search done and a provisional for relatively cheap to cover your bases till the time is right to file properly. And generally patent pending scares most people away.

It’s an idea not sure why we’re up to a patent…

First you make a prototype and then show it to experts in that field and if gets passed that you can think about making it happen in real life and deal with the next hundred steps..

My personal experience has been different than basically everything you mentioned. Got a utility patent in 6 months (rare but possible). Cost me less than half of what you mentioned. And patent pending did not scare anyone on Amazon away, and if it did, it was hard to tell when there were literally hundreds of knockoffs within months.

That product would have been dead in the water without a patent. Yes, it was expensive. But a provisional patent doesn't do anything for you when time is of essence.

Not always is a patent needed, but when it is, you rather not be caught without one.
