Touching is usually used to refer to sexually inappropriate touching, and carries that connotation. However, not every instance of any sort of standard casual friendly physical contact meets that standard.

No. If the mother believes this was all a misunderstanding, then that should be the end of it concerning law enforcement.

Not everyone is similarly trained and thinks like that. One's preconceptions fill in the lines to see a non-existent picture.

IMHO here is how the situation should have been handled in real time. The person should have been brought in for questioning. If he refused, then he should have been arrested.

I think we both watched the same footage, yet seem to have very different perspectives. I'm curious what the line which keeps being referenced is. Presumably you agree that shaking hands with a child is ok, even though it involves physical contact, being as it's casual and completely non intimate contact. If I'm wrong in that assumption, please correct me. Fondling a child intimately is unacceptable according to both of us. We seem to have differing opinions which one this falls into. In order for charges to be pursued, there should be a clear and probable cause to believe that this falls into the latter category, and that there's no legitimate reason for one to believe otherwise.

1) this wasnt lightly touching 2) Grooming and making a child feel "protected" by placing your arms around him/her is the step before sexual touching. No one would touch a child in a room full of a adults, he would make the child feel comfortable and lead him to a side room. Which is what seemed from the video.

Example: I show a video of me flipping a coin and it comes up heads. I called heads so I win.
You want to explain it was a two headed coin, so it has to come up heads. This is probably true, but no way is that what the video shows.
