DW is scheduled to fly JFK-OSL tonight with infant-in-seat. Her equipment is delayed coming into JFK, so I'm sure her outbound flight will be more than 4 hours late and she'll be eligible for EU 261/2004 compensation of 600EUR per passenger.

Considering how late the flight is departing, she doesn't want to fly tonight, and prefers to fly next week, but also doesn't want to forfeit 1200EUR in compensation. What is the minimum she can do (e.g. show up at the airport and request to be re-accommodated at the check in counter), that she'll still be eligible for compensation but won't have to sit with a baby and wait for a 7pm flight that might take off at 2am or later.

Basically, they are already willing to reschedule her now by phone for free, I would do that but I don't want to forfeit the mandatory EU compensation.

ETA: its delayed more than 5 hours, officially we're eligible for rescheduling and compensation, hopefully we'll get it.

I hear your dilemma.  While it sounds good about the EUR Compensation, how do you collect on that?
We should be getting compensation due to the Israeli law but we have no way to collect. (My daughter's flight was delayed leaving Israel 27 hours.)

You file, and once they approve your claim they are legally required to wire you the funds within a reasonable amount of time.

One of my clients (a couple) flew LY business class in September TLV - JFK - TLV, and on the return from JFK the flight was Hi Fly equipment. They had a miserable flight as the seats did not recline all the way as a bed, and they say the food was a different hechsher than they get with El Al and the food was cold. I helped them file a complaint with El Al, and El Al responded that they would compensate each passenger with 200 matmid points. Obviously, they weren't very impressed, so they sent back asking for a reevaluation of the situation, explaining that they especially paid all this money for business class to be able to sleep on the plane and being that they weren't beds, they weren't able to sleep.
Surprisingly, El Al responded last week and are giving them 2 free flights in business class to any El Al destination over 6 hours! Kudos to El Al for this one!

no as its a non EU airline departing from a non EU airport EU law only applies for either EU airlines or flights departing from EU airports

5 hour delay on ua79.  Everyone on flight was offered $125 voucher or 6250 milage plus.

Can't understand why they would give this for someone that purchased the cheapest class ticket?
