It's wild - we paid for both the prosecution (taxes) and the defense (fundraising).

It's wild - we paid for both the prosecution (taxes) and the defense (fundraising).

This happens all the time (albeit without the fundraising aspect). Police will violate someone's rights, and if it's egregious enough to get through qualified immunity and they get sued successfully, the city/county will pay. So the taxpayer pays for the police, jail, prosecution, etc. and then has to pay for when they get sued as well. If the defense here sued and were granted the court costs, the tax payers would be on the hook for that AND the costs in defending against that lawsuit itself.

There are ZERO repercussions to anyone in the justice system for screwing up. And the higher you go in the system, the tougher it is to raise an issue. Sorry @CountValentine this case only proves how awful the system is and how little faith you should have in it. Untold thousands were spent on a case that didn't even merit going to a jury. I would love to hear from criminal attorneys how often this happens, my guess is 0.0001% of cases.

Ofc they don’t say why the Judge tossed the case!!

And they quote the statement of the AG entirely. Typical APP.

"We are tremendously disappointed that the Court would prevent the jury from deciding this case, despite the extraordinary standard that applies to such motions. It is especially unfortunate that the Court ruled before, rather than after, a jury verdict, leaving the State no legal recourse,” said First Assistant Attorney General Lyndsay V. Ruotolo.  “Our important work continues beyond this individual case, and we remain committed as ever to tackling corruption or fraud when we confront it.”

From the attorney general office itself that they have no legal recourse and cannot appeal.

The articles are imprecise, but I assume that the motion that was granted was a motion for judgment of acquittal for insufficient evidence (which can't be appealed if granted mid-trial).

Here are the actual words that the judge said after his entire explanation:

"The easiest course of action for me today would be to just let this case go to the jury. I'm sure they would come to the same conclusion. But I have a professional and ethical obligation to rule when called upon. The evidence presented to the state's case in chief is insufficient to warrant a conviction. Accordingly, I hereby enter a judgement of acquittal."

Se'udas Hoda'ah is set to be livestreamed on the news sites. I can post a link here, but I think it's just simpler to see it on the news sites.

BIG PEOPLE TALK ABOUT IDEAS.

Not that it makes it okay, but the caption is almost certainly left the same as when the picture was first taken/published.

Ofc they don’t say why the Judge tossed the case!!
They added this since, "After the state rested its case, Judge Joseph Paone sided with Eisemann's defense team, which argued that the state failed to provide evidence of the necessary elements of the offense, defense attorney Lee Vartan said."

So the state can appeal on a matter of law as double jeopardy is not in the 6th but rather the 5th amendment (as @Euclid pointed out).

*This is a joke, in case anyone is unsure.

*This is a joke, in case anyone is unsure.
Joke aside, the state already conceded that they cannot appeal, in the statement yesterday from the AG's office.
