I just don't want to hurt the schools insurance too much as I have a strong sense of responsibility and personal investment in the schools wellbeing.

Another thought: if you sue and it goes to trial, can it lead to legal action against the school, staff, etc. because of the negligence?  Can it lead to discussion about individual people's actions and how that impacted the outcome?  If there is real negligence, can people be arrested, charged, etc.?  I have no experience, just wondering out loud.

To address the court discussion I was told insurance will almost for sure settle, and there will be no court case.
IME (dealing with 10s of GL claims), I honestly cannot think of a single case where we settled without a court case.

Na, these things hardly ever go to trial. I wouldn't be that concerned with this.

I think when he said "court case" he meant "trial".

You're not the first and won't be the last in this situation. First you need to consider your child's best interest and the child is entitled to compensation for his/her injuries. That being said, you should probably pull your kid out. It would be an uncomfortable situation and they may even throw your kid out.

I forgot to mention one other thing - be prepared for community pressure from the rabbis etc not to sue.

Hi,
 

 My child was injured in school due to negligence, and am considering suing the school. I spoke to a lawyer and was told it is fairly common practice but I have to consider if I can maintain a positive relationship with the school. Does anyone have experience in a similar situation or how it will affect the school regarding insurance?
I am surprised that the school did not lie and blame you and reported you to DCFS for child abuse! They do this all the time!

Also consider that it might get out that you sued the school (e.g. if they contact the school you sued after you say in your application that your kids previously went there), other schools might not accept your children because of that.
