Amex Purchase Protection Help

Recently had a bad story in which I sent someone to return some items for me at one of the big department stores, and I don't know how or why but she forgot to return an expensive sweater and left it in the bag which she asked the sales rep who was helping her to throw out. This was bought on a regular Amex green card. From what I understand since it was not a platinum their purchase protection only covers "theft and accidental damage" and not loss. Do I stand a chance? Any ideas/advise? Thanks

Why would this count as theft? Don't you need a police report when claiming theft?
