I always understood the issue to be that htey were never entitled to the CB for returned items and exploited the fact that the CB went through anyhow.
Why should they go to jail for Nordstrom's mistake? They issued the cash back. I agree that a case could be made for them having to return the money since it was issued by mistake but that they should go to jail for it is preposterous IMHO

Do you think that if there was a glitch on a bank system that you would be able to deposit a check multiple times it would not lead to criminal prosecution for someone who intentionally and maliciously takes advantage of it?

Well, some of us have lots of kids  :)
Take a survey amongst Israelis and ask them about the frum people having large families, and you will probably get an overwhelming majority that will have negative things to say,including how it's a financial burden on the country. That is a result of political brainwashing. Every honest economist will tell you that one of the best things for economic growth is population growth and high birth rates.

The US is in a much better shape than the rest of the developed world due to better attitudes towards high birth rates and large families.

The biggest economic challenge major economies are facing is negative population growth. Japan, Russia, Germany (which is why they allowed in so many "refugees", without considering other consequences, and the social change), France and most of the EU have this problem.

I don't think there is any comparison between the two. Depositing a check multiple times is taking money out of someones account without their consent.
 Nordstrom sent them (or fatwallet) a check to deposit. That they sent it  due to cancelled orders should be their problem not the brother's.
