Do your jury duty.

Manhattan Criminal Court:
The boring introductory speech takes about 45 minutes, and should begin relatively on time. Therefore, coming 45 minutes late is no big deal.

If you have a deferment, don't waster your time at the criminal court. Go straight to 60 Centre Street room 139. The line can get busy, so try to come at a good time.

How bright was the average juror ? Should they be deciding someone's fate ?

What's the alternative? As lousy a system as it is, it's far better than having your fate decided by single judge who may hate you just because you're black, jewish, etc. And of course in a criminal trial you can always have the judge decide your fate if that's what you prefer.

First off, if you think your taxes were high until now, imagine the state hiring thousands (if not more) of judges. Secondly, the idea of a jury trial is to protect citizens against the abusive power of the government. Your solution still has the same problem. Sure, the jury system is the butt of everyone's jokes, and rightfully so, but those that legitimately think we should get rid of it tend to lack an understanding of history. This is not to say that we can't seriously reform the system- I don't think it's necessary to have citizens miss days of work so they can judge whether the sidewalk wasn't paved properly.

Your solution still has the same problem.

The video they show you (in Kings County anyways) when you come in for jury duty shows historical cases where that is exactly what happened: a large group of judges unfairly sentenced innocents (to death, IIRC).

I was selected to a jury on a murder trial (got excused in middle, but that's another story). The jury was not made up of idiots at all. Just average lower-middle class Americans of all kinds of backgrounds and ethnicities. Although the other guys on the jury seemed more interested in getting an up close look at the knife that killed the guy than figuring out if the defendant was guilty :-)

In the jury selection process, a lot of people tried to turn themselves into racists, cop haters, and all sorts of things mentioned on this thread to get off jury duty. The judge didn't care for all their excuses.  Basically, if you're relying on those excuses, YMMV.

Unfortunately you could make the same video of juries sending away innocent & letting murderers loose. How many times have jurors based their decision on the person's community/color etc. Or if the victim is crying they'll have sympathy when it could just be a shpiel. & how many times has a juror been interviewed afterwards & said that s/he really feels it's the other way. Also there are lots of people that go in there hating the cops/law or just wanna go home. You're talking about possibly putting someone away for life.

Agreed. I believe the judicial system needs a lot of major improvements. I have no idea what the solution is, though.

There is no perfect solution. Only 2 people know if a crime was committed, the victim & the suspect.

Yes, our judicial system, as should any civilized judicial system, clearly prefers to err on the side of letting criminals go than locking up innocent people. Remember, a suspect can always choose to be tried by a judge if he prefers.

One of them had a massive heart attack right after & a different one died soon after getting out.
