ATT unlimited throttling is it a change of contract?

Does anybody know if the current ATT throttling of data usage over 3 gigs is considered a change in the contract to be able to get out of the contract?

they claim that they only promised unlimited data, they didn't say how fast

Did you see a guy sued and won the case against att... They paid him like $850 IIRC

Bunch of scurvy dogs! Any tips on dropping ATT?

Or more realistically, anybody know how these VPN servers work with the iphone? Do they really help on the data usage?

It was in a California Small Claims Court (don't remember which jurisdiction)

And ATT said they would appeal

Far as I know, they're not appealing. He got his $850 already ($85/mo x 10 mos left on contract).

Of course they will appeal -- any big company will appeal, even a small nuisance verdict (which $850 is obviously just a nuisance for ATT), if it sets a bad precedent/sends a bad message to others inviting them to do the same.
