Does anybody know if the current ATT throttling of data usage over 3 gigs is considered a change in the contract to be able to get out of the contract?
Did you see a guy sued and won the case against att... They paid him like $850 IIRC
It was in a California Small Claims Court (don't remember which jurisdiction)And ATT said they would appeal
Far as I know, they're not appealing. He got his $850 already ($85/mo x 10 mos left on contract).
Of course they will appeal -- any big company will appeal, even a small nuisance verdict (which $850 is obviously just a nuisance for ATT), if it sets a bad precedent/sends a bad message to others inviting them to do the same.http://www.dailytech.com/California+Man+Prevails+in+ATT+3G+Data+Throttling+Lawsuit/article24089.htm
