They are just blowing smoke you know where. You got your money so just let it go and move on.

I'm out $70 for the fees that I had to cover though.

Were the fees for notary and such? If so then there is not much you can do about them if they decide not to reimburse you.

No, what happened is a CC payment was supposed to hit the account basically on the same day and, because of the theft there weren't enough funds and he got a $35 returned check fee.
Then he immediately made a CC payment for the whole remaining balance but left $35 available in case the first unfunded payment would hit before the smaller payment (Amex's system tries 3 times and they aren't able to manually stop it) to make sure it just sucks out those $35 without affecting the 2nd payment.
That's $70 in fees caused by the theft.

If the relationship with the bank is over anyway, perhaps send in a complaint to the government agency overseeing banks (forgot the name, it's mentioned in the Chase AA thread).

I am not sure they did anything wrong and it would be a courtesy to return the fees. Here is the site and I guess it would not hurt.

Courtesy?? How about they should shell it out for paying out a thief's check? They should have verified the signature before releasing the money. Now they are trying to blame me for it??

As far as apple bank, I've gotten bad vibes from them as soon as I started dealing with them, and I soon stopped. I had family members lose money by them too, and in almost all cases if they were dealing with one of the bigger banks, they wouldn't have ended up paying those fees. I think they're very customer-unfriendly.

They're way too narrow minded to be a bank, period.

That reminds me, on two different occasions I wanted to withdraw 5k in cash, and they said they didn't have that much cash to dispense  ;D

I've heard the same from someone living in Long Island who tried making a big withdrawal from Apple there and they told him the same thing (many years ago).

LOL,
They probably meant 'cash on hand'. But either way, sounds really bad to hear that from a bank.

I understand you are upset/mad about this. Just giving my view based on my interactions with banks. I think it would be totally unreasonable to expect any bank to verify every signature is real and I do not think they are required to do so.

IMO the fees go hand-in-hand with the reimbursement of the check. If they agree that they're liable to refund for the lost check, they're responsible for all the side effects as well.
