Even assuming selling miles allows the airline to shut the acct (which IIRC has generally not been so decided by the court), wouldn't the burden of proof lay upon BA that the miles were actually sold?

I wouldn't believe it impossible for him to win a large sum.

I hear the lawyer BA hired is not big-fancy guy

Yup, quite likely IMHO. But then people will start trading openly, and the airline will have no choice but to allow award for account owners only.
