Fake Mophie Juice Pack Plus

I purchased a Mophie Juice Pack Plus for my Iphone on ebay.  Within the month, the thing stopped charging.  I sent it back to Mophie who said that it was a fake.  Does anyone know if this would be covered under ebay buyer protection? Is there any other way to get my money back if the buyer refuses?
