I am sure many people were right in court, but lost anyway. But if he doesn't have proof he has a tough case to argue, I suppose the burden of proof would be on him.

They did. He booked tickets for a phony person just to have an empty seat next to him. There is a big difference if he booked for 2 people rather than himself and an empty seat. The later was probably not allowed or mentioned in the contract hence doing so would be a breach of contract. So what I was saying is that now the burden of proof seems to be on him to prove he was allowed to do that.

That's exactly AA's point it must be a second person to book a second ticket. By making up a name he in order to book an empty seat he is breaking the contract. He is the selfish one here. Just because you can bring a companion along, doesn't mean you can book a seat empty.

Don't you get what you pay for and no more? If it doesn't say he's allowed to do that then he's breaking contract. No? Although if their agents booked it every time AA doesn't have much of an argument.
