Do you leave the cans open for a while after garbage pick up? The flies will lay eggs during that time in the can. I think the rain just surfaces them because they drown

Here's a great defense to many cell phone tickets.

N.J.S.A. 39:4-97.3 (NJ Cell Phone While Driving) https://law.justia.com/codes/new-jersey/title-39/section-39-4-97-3/ says:

1. a. The use of a wireless telephone or electronic communication device by an operator of a moving motor vehicle on a public road or highway shall be unlawful except when the telephone is a hands-free wireless telephone or the electronic communication device is used hands-free, provided that its placement does not interfere with the operation of federally required safety equipment and the operator exercises a high degree of caution in the operation of the motor vehicle. For the purposes of this section, an "electronic communication device" shall not include an amateur radio.

"Hands-free wireless telephone" means a mobile telephone that has an internal feature or function, or that is equipped with an attachment or addition, whether or not permanently part of such mobile telephone, by which a user engages in a conversation without the use of either hand; provided, however, this definition shall not preclude the use of either hand to activate, deactivate, or initiate a function of the telephone


What that means, is that it is 100% allowed for you to use your hands to activate, deactivate, or initiate a function of the telephone

What you should do - is plead not guilty. Then they will ask if you want to go to trial - and you say yes, and cite this statute, and that they need to conclusively prove that you were not simply activating (dialing) deactivating (hanging up) or initiating a function (such as putting address in GPS etc).
They will not want to bother with a trial that they know they'll lose and they'll offer to knock it down to a basic non cell phone $50 ticket or so.

Note that in NJ, 2nd and 3rd cell offenses get worse and worse, so key is to not having it recorded as cell ticket.

Where do you see anything in the statute about inputting an address into the phone GPS? How is that different than texting or writing yourself a grocery list while driving?

Maybe ask in the Tech forum instead about how you might be able to find out yourself whether it has a virus.

prosecutor offered to change it to a improper turn at arrow 39:4-116
Still a moving violation but

I see that the courts have ruled that inputting a password is considered texting and not initiating.

So would manually inputting a 30 item music play list. I doubt that would fly. Good luck trying to get a judge to agree to that interpretation. The intent of the language of the statute “initiate a function” is clearly referring to answering, disconnecting, etc. and might not even cover inputting a phone number, much less other smartphone functions not related to the “communications device function.”
