FBI AGENTS STORM LAKEWOOD SCHOOL, OFFICES, SCHOOL OWNER'S HOME

Lakewood, NJ - Over 30 federal agents raided three different locations in Lakewood this afternoon. After staging in the parking lot of 95 East Kennedy Blvd, special agents executed warrants and entered SCHI offices in the Chemed Plaza. Agents were seen taking out boxes of documents from the school directors house.

The school located on Oak street was raided as well.

The filing of tenure charges last week against Helen Tobia, the Lakewood School District’s supervisor of pupil personnel services, should be a clarion call to fully investigate whether the longstanding double standard for placement of special education students still exists in the district.

For years, we and other critics of the school system have complained that the district routinely placed Orthodox special needs children in private schools catering to the Orthodox community, where the tuition can be $90,000 a year or more, while minority children generally received services in the public schools.

Our 2012 four-part series about the dire straights of Lakewood’s schools, “Cheated,” revealed the sad, ugly story. Three years later, those problems seemingly remain.

The charges against Tobia, which were filed by the district’s state-appointed monitor, included overstepping her authority to place children with special needs in Orthodox yeshivas and private specialized schools at their parents’ request, according to court documents.

Gov. Chris Christie and his administration, as well as Rep. Chris Smith, R-N.J., and state Sen. Robert Singer must make certain the state gets to the bottom of this mess. It must be determined whether Tobia was acting on her own or was simply following orders from other school administrators, the school board or others. After all, the practice started long before she took her current position in 2013.

Tobia’s chief responsibility was to oversee the district’s special education program, including the child study teams. Those teams are required to evaluate children believed to have disabilities, and then craft an individualized education plan to meet their special needs. Parents, teachers and therapists are supposed to have input on the final plan. This was apparently not always the case with Tobia at the helm.

She is alleged to have acted unilaterally on numerous placements. In one instance, the complaint states, Tobia ordered that a child be denied special services before the child was ever evaluated by the child study team.

In practice, once a child’s needs are identified, the child study team has to determine whether the district can adequately provide the services the child needs within the public schools. If that isn’t feasible, the team may decide the best alternative is to place the child in a specialized, out-of-district private school at the district’s expense.

The latter has happened much more often for Orthodox children than for minority students. In 2012, $12.5 million in tuition was spent to send 130 disabled students, virtually all of whom were Orthodox children, to the School for Children with Hidden Intelligence, or SCHI.

The state has a responsibility to determine whether placement of special education students in Lakewood is being handled equitably and in accordance with the law. Three years ago, it wasn’t.
