Too tired to read through this thread, but Ive never seen a NYC-TLV flight with less than 90% load, and rarely with less than 100%. I do think Elal had a real loss on this, albeit I doubt they shoulder it themselves. At any rate the law in this case is specifically designed to penalize airlines for mistakes (or at least that's my understanding of it).

Obviously this is based on my personal experiences, please post your constructive arguments.

Just a P.s. I love how people (Rabbis included) casually define "Dina Demalchusa Dina" ad-hoc. What are their sources? (I'm not just referring to the OP, some DDFers (not to compare them to Rabbi Marburger) acted similarly recently)

It is from the most complicated halachos in CM, I actually recall reading that Rabbi Marburger gave a shiur specifically about this topic at some conference I don't remember details.

pretty sure there its an article in one of the rjj journals about it. I think you can also find some materials in Rabbi Dr. Aaron Levine's books

You missed the boat. No one is saying that he not a good rov. People are just trying to understand how he paskened (seemingly)  without knowing the fundamentals of the airline industry.

Again he said he doesn't even know the price of a ticket to Israel 

And +1 no one is challenging him in chosen mishpat but rather wondering how he reached a psak halacha w/o full knowledge and comprehension of the airline business...

If anyone could locate this "Rabbi" for me I will definitly give him a piece of my mind. Seems to me like he's just so mad that he didn't get the tweet and missed the deal. He obviously didnt talk to anyone about it before his lashon hara shmooz and is living in his own world... Shame on him!
