I could be wrong but I think an assault charge is not physical, that would battery.

Just looked it up, and it shows how much I've retained since my bar days.

NY actually combines both assault and battery into the same statute.

In other jurisdictions where they're separate, you'd be correct (without getting too technical).

imo the police will probably not get punished that much without audio since his Union will protect him and at most they will settle on some lesser form pf punishment

Na no worries... I am no Anarchist but if a peace officer abuses the badge they deserve the very harshest punishment they can get. It shows a flaw in their very ideals. Violating the law you swore to uphold is no laughing matter.

So if I'm understanding this correctly both a threat (seemed obvious to me) and words that are "inherently likely to provoke a violent reaction" are not protected speech? However, can you insult a policeman yet not threaten him physically? Not saying I plan on doing it... but wondering just the same...

he was woken up from his sleep, got out of bed, and the video shows that he was passive.
He did not attempt to hit them. He did not want to be handcuffed. He's from Israel - maybe he didn't know what they were saying..

The police wrote up how he hit them when they drove him to prison. He was there for 2 days YT until people released him and they saw inthe video that he did not do to the police what the police claimed that he had done. They wrote false claims against him. They did not know that they were on videotape.

$1 million minimum had this beating been done out of the blue by to other residents of CH.
First 2 full minutes of beatings by 2 cops who can't cuff him, the incompetent lady cop who keeps dropping things is smacking him with a stick.
Then a 3rd and 4th cop come and yank him onto the floor, There are ELEVEN cops in the room by the time he is subdued on the floor. They yank him up without mercy. A major nightmare. If his lawyer gets 30%, and some may go to ALIYA as tzedakah, then he's only getting $50K.

true he was resisting, but maybe he was not read his rights/did not understand the English language.
Yes, the officers were incompetent and out of control. They acted as if they were angry at him Yes, he deserves a lot more money.
Just the 2 nights in prison and false charges against him is $100K.
Another $750,000 for multiple long beatings, imo.

In any case, that doesn't deserve 6 people surrounding him and physically beating him for several minutes.
They lied in the police report that he assaulted the Officer and caused injuries to the police. That was going to be a 7 year prison sentence against him.

The prosecutors only dropped the charges after the video was found and made public. If not for the video, their lie would translate to an innocent person in prison for 7 years.
