AMEX T&C on all cards state you can't have had the card within the last 12 months. Most usually specify the family (Gold, Platinum, Zync). Usually no crossover biz to personal (i.e. you can get biz bonus when you have personal).
Sometimes they only disallow that card (i.e. if you have platinum you may still get gold).
How do you know what the terms are?
READ THE T&C ON THE APPLICATION PAGE. THEY ARE VERY CLEAR!!!

Update 4/24/13:
It's no longer clear who will get the bonus, but it's very clear who will not receive it.

Beware of the new addition to the T&C of personal cards:
If you are identified as a current American Express® Cardmember, you may not be eligible for this welcome bonus offer.
We don't know yet the effects, it can't be good, so take it into consideration. It might be a way to cut off churners even after a year of having the product.

You should always send a SM several times. There were multiple reports of success if persistent enough after being denied the bonus. Don't bother calling, only SM! Don't give up so fast. Be creative and harsh. Say that a rep told you that you will get the bonus on the card. Follow up, demand an investigation and follow up again.

I am on the phone with a representative and she is saying that after May 1st, you are only eligible for bonus points on a card once in a lifetime for a card!

I know someone who got a bus gold a month ago. A week ago he applied for a bus plat thru an offer that came in the mail. He got approved. Will he get the points? It said nowhere on the offer that there's a 12 month rule.

I noticed some references on this thread about filing a complaint with consumerfinance.gov. Has anyone tried it?

I received a targeted offer for 50k Delta miles, along with the usual terms that I would only be eligible if I didn't have the product in 12 months. Uncertain about whether I had the card within 12 months, I chatted with a rep online who said that they don't see any such card on file within the last 12 months, and then went ahead to assure me that I would indeed receive the bonus if I signed up. I chatted not once, but twice to confirm this. I have a copy of one of the chats.

Sure enough... no bonus. I called in, rep was very helpful and sent a claim to the marketing department... whom of course turned me down stating that I had the card withing 12 months. I called in again and spoke with a supervisor who said he is sorry but there is nothing he can do, even though he understands that I was explicitly told that I would receive the bonus. (He also said that Amex would be taking accountability for this and reporting themselves to the consumer affairs bureau for making such a mistake and providing me with misinformation. I almost laughed out loud. Then he said that I didn't gain, but I didn't either lose anything, to which I responded that I lost points on my credit score for the inquiry, and I spent money on the card to meet the bonus criteria, money which I could have spent on another card and received better points for.).

The question is, is it worth filing a complaint with the CFPB? Can this backfire?

In general, Amex is good to me, but this is just crazy.

My concern is if it will somehow backfire.. i.e. will they start delving into my account and seeing all the cards I opened and closed, and then start asking about my business etc...

Or, will they simply look at the case and change their mind?

I remember when a coke was a nickel, and you could buy VRs in OD.

I got approved during the limbo stage for 150k that was sent to my address( landlord) I was assured they would honor the offer & now that I did the spending (20k) I was told they won't honor. First they said I wasn't eligible for the offer because their system doesn't show me able to recieve such a large offer ( they have me 25k offer instead) then they said I am not eligible because I previously had the card( 3yrs ago!). Not sure what to do ..

Some period back in April.  It was the time between when the AMEX Terms & Conditions were modified from "One bonus every 12 months" to "One bonus per lifetime" and the date of May 1st.

isn't the 150k offer for business?
If so you should be able to churn it...

It was buiz card. I applied for 25k & then recieved 150 in the mail. I faxed it I'm & they told me they would apply it to my account. Now that I did the spending supervisor told me he ran all the calls & even though the rep told me Amex will honor it ( she even gave me her name to refer in case any issues come up)- still they will only honor the 25k on the application( which already posted to my account) I sent Amex a ms & thur sent back that I'm
Ineligible for any offer per t&c as I am not a new card holder. ..

its 99% waste of time if thy didn't give you the bonus because of the t&c amex will not give it to you i had 100k PLT denial just because thy didn't finalize my application and i was approved for BGR on the mid-time even though i applied for the PLT first nothing helped i huca and send it for review nothing doing "we are sorry but we cannot give you the bonus" >:( :( 

though if you approved after the dead line of promo u might have a success sending u case for a review u may need to huca to get a rep to do it for you

If I have a Gold Delta Skymiles card, will I be able to also get the bonus for a Platinum Skymiles card? Are they considered the same product?
