I honestly don't know it. All I've heard was that it went to court, and Aish used protectzia. But they owned the property, and I guess they had rights to build up. I don't know IL building/zoning law.

That's not the whole story. At the time that Aish got the property and announced plans to build (20+ years ago) many of the people sold pretty low and the new people who bought gambled on the fact that Aish wouldn't get done. Same story with most of the buildings in the plaza area. The Goren family has done quite well for themselves :)

From what I've heard from a Rabbi at Aish, the law is that the height of all buildings were "grandfathered" at the time the Old City was recaptured, i.e. as tall as any given building was at the time, it could be knocked down and rebuilt up to that height forever. This is true even if only part of the building was standing. In Aish's case, one wall of the previous structure on that spot remained after the war... which was enough to get them the rights to build their entire new building to that height.
