Collection Agency Questions

1) Is a collection agency allowed by law to report someone to the credit bureau without prior notification and warning that they will actually do so?

2) Does a collection agency have the ability to report someone to the credit bureau if they don't have the persons correct SSN (they have the correct name and DOB)?

I've seen it happen that a collection agency assumed that "sam schwartz" in brooklyn was the sam schwartz in queens - different person with a different social - but didnt report to credit - just sent letters..never got further

I have been getting calls for some time now from a collection agency, thinking that I'm someone else. They just don't stop calling...

a case like you describe can be worth $1000.00 I've been dealing with a great attorney specializing in this area. (don't know if i am allowed to mention his name here)

I heard something along the lines of mailing them a letter and they have 30 days to answer otherwise the claim is removed from your credit

you don't want to quiet them down, keep them sending you letters, and sooner rather latter they will be in violation of the law, and a good attorney will get $1000 and then you may want to pay them.

Thats true - have heard the stories from reputable chaveirim...but it depends on the company - theyre slowly learning to stay above (literally) the letter of the law...

I knew there would be a thread on this subject but I can't believe it's been quiet for 10 years!

E-z pass sent me a bill for 2 tolls in the mail along with 2 $50 administrative fees even though I had a transponder. I called up and they said removed the fees. I checked my ez pass statement and I see they didn't charge me for the toll. Now I'm getting letters from a collection agency about the toll and the fees. Of course ez pass nj is closed on the phone so there's nobody to talk to.
Any advice?
