Not intimately familiar, but I believe no-fault may come into play here.

(NY is a no fault state.)
So does that mean my insurance will go up?
Im on phone, it seems she made the claim already. I hope she was honest.

Both of those videos would just add to my point, not argue with it. Unless I'm missing something.

My point was that its not as clear cut as everyone makes it that the driver behind is always at fault.

If he has a witness or some other small proof, it may tip the scales to win his claim.

Ok just got off the phone with statefarm,

She told them that she reversed into me. They said shes at fault.
They said now the 2 options are to either go to one of their repair shops and they'll repair or have them come to me ,assess the damage  ,pay me for it and I could take it to any repair shop.

What do people usually opt for?

Do you own the car or lease, and if lease do you have damage waiver
I had a bus back into me, never fixed it but charged them the price to repair it and took it off the damage waiver

have them come down to you and take the check. you can usually get someone to fix it for you for cheaper than their estimate

+1
Take what they give you and then shop around to see how cheap it might be to actually repair it. Then you can decide whether you want to bother fixing it at all.

I can meet him at the repair shop, they will try to negotiate a better price.

Or better to meet at home?

I know the guy my parents use does this. He'll point things out to the adjuster to try to get the estimate up. Then he'll do the repairs at a discount to what you're getting.

But the check still gets sent to me though? so I could decide what to repair

I'm fairly certain that's the case, but you could check with the collision guy to make sure.

Thats what the insurance company said, unless I authorize him the payment.
Otherwise I would rather not meet at collision shop.
Anyone know if this is the case with statefarm?

Do you plan on getting the car fixed or keeping the money?

I would probally need to get it fixed eventually. Maybe I would wait until it gets worse.

I would then get three estimates and have SF cut you a check for the middle one.

SF has their own appraisers, the question is if they pay more if i meet him in a shop vs my house.

Hertz called me earlier and left me a message about the loaner car,  how does it work- its only while being repaired?

Does not matter shop or home. You want to get your own estimates to know what they should offer you. If their offer is higher of course don't say anything.

Generally besides for assessing the damage,  the appraiser will give a certain amount of time for how long the repair should take. Whatever amount of days he says - that's how many days insurance will pay for the rental car.

Your job is to make sure the shop that you choose is able to complete the work in the allotted time, otherwise you'll be out of a car for some time. . .
